Net Distribution Services Pvt Ltd is the authorised online retailer appointed by the authorised importer Tiger Pug Commerce Pvt Ltd. The Website features logos, trademarks, trade names, slogans, content, and images that are the registered trademarks or intellectual property or original creation of WHOOP (also referred to as the “Brand Owner”). Throughout the site, the terms “we”, “us”, “our”, “NDSL” and “ND Commerce” refer to Net Distribution Services Pvt Ltd. The website whoop.in is only for enabling selling of WHOOP Brand Products in India. It does not cover the sale of subscriptions and services that are provided by the Brand Owner. For more details about WHOOP and its products and the Terms of Use of WHOOP Products and Subscriptions the user needs to visit www.whoop.com.
The domain name whoop.in (hereinafter referred to as the "Website") is registered in the name of WHOOP.
Net Distribution Services Private Limited (NDSL) is authorized retailer and is allowed to use this domain for the Website.

THESE TERMS OF SALE, TOGETHER WITH THE WHOOP TERMS OF USE, WHERE APPLICABLE, SET FORTH THE LEGALLY BINDING TERMS AND CONDITIONS FOR YOUR PURCHASE AND USE OF THE WHOOP PRODUCTS, WHICH INCLUDE BUT ARE NOT LIMITED TO THE WHOOP STRAP (AS DEFINED BELOW), MEMBERSHIPS, AND ANY OTHER PERIPHERALS, ACCESSORIES, APPAREL, OR ANY PRODUCTS THAT YOU PURCHASE FROM OUR ONLINE STORE (“WHOOP.IN”) (COLLECTIVELY, THE “PRODUCTS” OR THE “WHOOP PRODUCTS”). THESE TERMS COVER IMPORTANT INFORMATION ABOUT THE PRODUCTS YOU PURCHASE AND ANY CHARGES AND AMOUNTS THAT WE BILL YOU.
YOU REPRESENT AND WARRANT THAT YOU HAVE THE RIGHT, AUTHORITY, AND CAPACITY TO ACCEPT AND AGREE TO THESE TERMS OF SALE AND ARE OF SUFFICIENT LEGAL AGE IN YOUR JURISDICTION OR RESIDENCE TO ENTER INTO THESE TERMS OF SALE AND TO PURCHASE AND USE THE PRODUCTS. “YOU” AND “YOUR” REFER TO THE PERSON PURCHASING A PRODUCT OR IF YOU PURCHASE A PRODUCT ON BEHALF OF AN EMPLOYER, COMPANY, ORGANISATION, OR OTHER ENTITY, THEN (I) ALL REFERENCES TO “YOU” HEREIN INCLUDE YOU AND THAT ENTITY, (II) YOU REPRESENT AND WARRANT THAT YOU ARE AN AUTHORISED REPRESENTATIVE OF THE ENTITY WITH THE AUTHORITY TO BIND THE ENTITY TO THESE TERMS OF SALE, AND (III) YOU AGREE TO THESE TERMS OF SALE ON THE ENTITY’S BEHALF.
BY PLACING AN ORDER FOR A PRODUCT, you acknowledge that you have read, understood, and agree to be bound by these Terms of Sale. If your order includes a Membership, you also accept the Terms of Use of WHOOP which are on www.whoop.com. If you do not accept these Terms of Sale, then you are not authorised to purchase Products from whoop.in.
We reserve the right to change these Terms of Sale at any time, so please review the Terms of Sale each time prior to making a purchase from whoop.in. Every time you order Products, the Terms of Sale in force at that time will apply between you and us. If you have any questions regarding these Terms of Sale, you can contact us at [email protected]. In these Terms of Sale, any words following the term “including” or any similar expression shall be construed as illustrative and shall not limit the sense of the words, description, definition, phrase or term preceding those terms.
While all of these Terms of Sale are important, you should pay particular attention to: (a) payment obligations (Section 5); (b) disclaimers (Section 10); and (c) limitation of liability (Section 11).
1. INTRODUCTION
Some of our Products, such as the WHOOP Strap (the “WHOOP Strap”), are included with subscription services provided by WHOOP (the “Membership”) in conjunction with the WHOOP Strap and which allow the user to track, manage and share wellness-related information collected by the WHOOP Strap. To make use of the Membership, a user must create an account (“Account”), as described in the WHOOP Terms of Use available at www.whoop.com. If you are the user of a Product for which agreement to the Terms of Use is necessary in order to use the Product, please be sure to review WHOOP Terms of Use for specific terms regarding your Membership and the related services. If you are purchasing a gift for which agreement to the Terms of Use is necessary in order to use a Product, the recipient of the gift will be required to review and agree to WHOOP Terms of Use before being permitted to use Product or the applicable Membership and related services.
Whoop.in is accessible in India and for sale of products in India. The Products offered on whoop.in are not designed and tested for use in all countries. If you choose to access whoop.in and/or use the Products, you choose to do so on your own initiative and you are solely responsible for complying with applicable local laws in your country.
You understand and accept that the Products and any related services are not designed for use in all countries and some or all features may not work or be appropriate for use in all regions.
2. WHOOP AUTHORISED PARTNERS
We may collaborate with certain brands (“WHOOP Authorised Partners”) to offer integrations with WHOOP Products. Such partners will be identified on whoop.in.
3. AVAILABILITY
All Products are subject to availability. We reserve the right to impose quantity limits, reject orders, or discontinue Products without notice. We do not warrant the accuracy of descriptions, images, features, or specifications. Colours displayed depend on your device and may vary.
4. PRICING
Prices are stated in Indian Rupees and include GST unless otherwise mentioned. Shipping charges (if any) are shown at checkout. We reserve the right to change prices; however, changes do not apply to already placed orders.
If a Product is listed at an incorrect price due to typographical or system error, we may cancel the order and refund the incorrect amount charged.
5. PAYMENT
By providing a payment method, you confirm you are authorised to use it and you authorise us or our payment processor to charge the total amount. Failed transactions may result in order cancellation. Payments are processed according to the processor's terms.
6. RESALE AND TITLE TRANSFER
Products purchased from whoop.in are for personal use only and not authorised for resale. Title transfers upon delivery to the carrier, subject to shipping terms.
7. SHIPPING AND DELIVERY
Delivery timelines shown are estimates only. Delays may occur. Refused deliveries are returned to our warehouse and may take up to 45 days for processing.
8. RETURNS FOR REFUND
Only unopened and unused products received damaged or not as ordered may be returned within seven (7) days. Used or worn items are not eligible for refunds.
9. COMPATIBILITY
Only WHOOP Products and WHOOP Authorised Partners are compatible with WHOOP devices. Using unapproved accessories may void warranties.
10. WARRANTIES AND DISCLAIMERS
To the extent permitted under applicable law, Products are provided “as is.” WHOOP and NDSL disclaim liability except as required under Indian consumer laws.
11. LIMITATION OF LIABILITY
WHOOP and NDSL shall not be liable for indirect, incidental, or consequential damages. NDSL's liability is limited to the sale transaction value under Indian law.
12. DATA PROTECTION
By ordering, you consent to data processing as described in our Privacy Policy. Information may be shared with WHOOP and service providers for order fulfilment.
13. ELECTRONIC COMMUNICATIONS
By using whoop.in, you agree to receive electronic communications. Email notices shall be deemed delivered when sent.
14. NOTIFICATIONS
Notifications may be sent via email, hard copy, or website postings. Add @whoop.in and @ncommerce.in to your email safe list.
15. FORCE MAJEURE
We are not liable for delays caused by events outside our control such as natural disasters, strikes, or system outages.
16. CONFIDENTIALITY & INTELLECTUAL PROPERTY
WHOOP may seek equitable relief to protect intellectual property or prevent loss or data misuse.
17. ASSIGNMENT
You may not assign rights or obligations under these Terms. We may assign them without restriction.
18. SEVERABILITY
If any provision is held invalid, the remaining provisions remain in effect.
19. SURVIVABILITY
Sections 10–24 survive termination of these Terms.
20. NON-WAIVER
Failure to enforce any part of these Terms does not constitute a waiver.
21. EXPORT CONTROLS
You agree not to export Products in violation of applicable export laws.
22. GOVERNING LAW & JURISDICTION
These Terms are governed by the laws of India. Disputes shall be subject to Mumbai courts. WHOOP’s Terms of Use are governed by U.S. law and subject to the jurisdiction of Boston, Massachusetts courts.
